References to "Niftact", "we", "us", or "our" in these Terms refer to Izaz Iqbal Ltd.
2. ACCEPTANCE OF THESE TERMS
2.1 BY CREATING AN ACCOUNT
By registering for a Niftact account at app.niftact.com — whether via email and password or via Google Sign-In — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional policies or guidelines we publish from time to time.
2.2 AGREEMENT WITHOUT A CHECKBOX
These Terms form a legally binding agreement between you and Izaz Iqbal Ltd from the moment you create an account. You do not need to tick a separate checkbox for these Terms to apply. If you do not agree with these Terms, you must not register for or use Niftact.
2.3 TERMS ARE LINKED IN OUR FOOTER
A link to these Terms is always accessible from the footer of www.niftact.com. It is your responsibility to review these Terms periodically, as they may be updated (see Section 23).
2.4 GLOBAL USERS
Niftact is available to users worldwide. By using our Service, you confirm that you are permitted to use it under the laws of your country or jurisdiction. These Terms are governed by the laws of England and Wales regardless of where you are located.
2.5 BUSINESS USERS
If you are registering on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these Terms. "You" and "your" in these Terms refer to both you personally and the organisation you represent.
3. DEFINITIONS
In these Terms, the following definitions apply:
- "Service" — The Niftact platform, website, and all related features, tools, APIs, and integrations provided by Izaz Iqbal Ltd.
- "Customer" — A business or individual who registers for a Niftact account (Free, Pro, or Business plan) to embed the chat widget on their website.
- "End User" — A visitor or user of a Customer's website who interacts with a Niftact-powered chat widget embedded on that website.
- "Widget" — The Niftact AI chat widget script that Customers embed on their websites via a single script tag.
- "Account" — A registered Niftact Customer account created at app.niftact.com.
- "Content" — Any data, text, documents, files, configurations, or other material uploaded to or created within the Niftact platform by a Customer.
- "AI Output" — Any response generated by the Niftact chatbot, powered by OpenAI, Google Gemini, or Niftact's own proprietary AI model.
- "Knowledge Base" — The document and file upload area within Niftact used by Customers to train the AI on their own business data.
- "Plan" — A Niftact subscription tier: Free, Pro, or Business.
4. DESCRIPTION OF SERVICE
4.1 WHAT NIFTACT DOES
Niftact provides businesses with an AI-powered chat widget that can be embedded on any website using a single line of code. The platform enables Customers to:
- Deploy an AI chatbot that engages their website visitors 24/7
- Train the AI on their own business documents and FAQs
- Collect leads and visitor contact information
- Configure live chat hours and escalate to human agents
- Integrate voice capabilities via Vapi (Pro & Business plans)
- Sync leads to HubSpot CRM (Business plan)
- Customise and white-label the widget (Pro & Business plans)
4.2 PLANS AVAILABLE
Niftact is offered on three tiers:

- Customisation & white-label (Niftact branding removed)
- Priority support
BUSINESS PLAN ($74.99/month)
- Everything in Pro, plus:
- Custom AI recommendations
- HubSpot integration
- Unlimited conversations
- Onboarding support
- Unlimited chat history (no automatic deletion)
4.3 FEATURE CHANGES
We reserve the right to add, modify, or remove features from any plan at any time. Where changes materially affect paid plans, we will provide reasonable notice (see Section 23).
5. ACCOUNT REGISTRATION & ELIGIBILITY
5.1 REGISTRATION
To use Niftact, you must register for an account at app.niftact.com using either:
- A valid email address and password, or
- A Google account via Google Sign-In (OAuth)
5.2 ACCURATE INFORMATION
You agree to provide accurate, current, and complete information when registering and to keep your account information up to date. Providing false or misleading information is a violation of these Terms and may result in immediate account termination.
5.3 ACCOUNT SECURITY
You are solely responsible for maintaining the confidentiality of your account credentials. You must not share your username or password with any third party outside of authorised team members added through the Niftact dashboard. You are responsible for all activity that occurs under your account.
If you become aware of any unauthorised access to your account, you must notify us immediately at support@niftact.com.
5.4 ONE ACCOUNT PER USER
Each individual may only maintain one Niftact account unless expressly permitted by us in writing.
5.5 TEAM MEMBERS
Customers may invite team members to their account up to the limit of their plan (1 on Free, 5 on Pro, unlimited on Business). Team members must comply with these Terms. The account owner is responsible for all actions taken by their team members.
6. USER RESPONSIBILITIES & PROHIBITED CONDUCT
6.1 ACCEPTABLE USE
You agree to use Niftact only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service — and the use of the Service by your End Users via your embedded Widget — complies with all applicable laws and regulations in your jurisdiction.
6.2 PROHIBITED CONDUCT
You must NOT use Niftact to:
(a) ILLEGAL OR HARMFUL CONTENT
Post, upload, transmit, or facilitate any content that is unlawful, defamatory, obscene, fraudulent, threatening, abusive, hateful, or that violates the rights of any third party, including intellectual property rights.
(b) SCRAPING & REVERSE ENGINEERING
Scrape, crawl, copy, decompile, disassemble, reverse-engineer, or attempt to extract the source code, algorithms, or underlying structure of the Niftact platform or any part of it.
(c) CREDENTIAL SHARING
Share your account login credentials with any unauthorised third party, sell access to your account, or allow others to use your account outside of the authorised team member feature.
(d) SPAM & UNSOLICITED COMMUNICATIONS
Use the Niftact Widget or platform to send unsolicited messages, promotional material, or spam to End Users or any third parties.
(e) SECURITY ATTACKS
Attempt to gain unauthorised access to any part of the Niftact platform, its systems, or the accounts of other users. Transmit any malware, viruses, or other malicious code.
(f) AUTOMATED ABUSE
Use bots, scripts, or automated tools to interact with the Service in a way that places an unreasonable or disproportionate load on our infrastructure.
(g) IMPERSONATION
Impersonate Izaz Iqbal Ltd, Niftact, any employee, or any other person or entity in connection with the Service.
(h) CIRCUMVENTING RESTRICTIONS
Attempt to bypass, disable, or circumvent any access controls, plan limitations, or security features of the Service.
(i) RESELLING WITHOUT AUTHORISATION
Resell, sublicense, or otherwise commercially exploit access to the Niftact platform without our prior written consent.
6.3 CONSEQUENCES OF PROHIBITED CONDUCT
Violations of this section will result in a warning followed by suspension or permanent termination of your account, at our sole discretion, depending on the severity of the violation (see Section 18). We reserve the right to report illegal conduct to the appropriate authorities.
7. CUSTOMER RESPONSIBILITIES FOR WIDGET DEPLOYMENT
7.1 SHARED RESPONSIBILITY
While Izaz Iqbal Ltd provides and maintains the Niftact platform, Customers share responsibility for how the Widget is deployed and used on their websites. This shared responsibility model means:
NIFTACT IS RESPONSIBLE FOR:
- The technical functionality of the Widget and platform
- The reliability and security of the underlying AI infrastructure
- Processing data in accordance with our Privacy Policy
- Ensuring the core platform complies with applicable laws
THE CUSTOMER IS RESPONSIBLE FOR:
- How and where the Widget is embedded and used on their website
- The accuracy and legality of content uploaded to the Knowledge Base
- Configuring the Widget appropriately for their audience
- Ensuring their use of the Widget complies with laws applicable to their business and jurisdiction
- Informing their End Users about the Widget and data collection through their own website's privacy policy
- Obtaining any required consents from End Users, including for voice recording where Vapi is enabled
7.2 END USER COMPLIANCE
Customers are solely responsible for ensuring that their End Users' use of the Widget does not violate these Terms or applicable law. Niftact is not liable for any harm caused to End Users as a result of a Customer's improper deployment or configuration of the Widget.
7.3 DATA CONTROLLER OBLIGATIONS
As noted in our Privacy Policy, Customers are the Data Controllers for their End Users' personal data collected via the Widget. Customers must have a lawful basis for this data collection and must maintain their own privacy notices accordingly.
7.4 VOICE RECORDING DISCLOSURE
Customers who enable Vapi Voice Integration are solely responsible for notifying their End Users that calls may be recorded and for obtaining any legally required consent prior to recording.
8. AI-GENERATED CONTENT & DISCLAIMER
8.1 NATURE OF AI OUTPUTS
The Niftact platform uses artificial intelligence — including models from OpenAI, Google Gemini, and Niftact's own proprietary AI — to generate chatbot responses. These AI Outputs are generated automatically based on the inputs provided and, where applicable, the content in a Customer's Knowledge Base.
8.2 NO WARRANTY ON AI ACCURACY
Izaz Iqbal Ltd makes no representations or warranties — express or implied — regarding the accuracy, completeness, reliability, or fitness for any particular purpose of any AI Output generated by the Niftact platform.
AI systems can produce incorrect, incomplete, outdated, or misleading information. AI Outputs should not be relied upon as professional advice of any kind, including but not limited to:
- Legal advice
- Medical or health advice
- Financial or investment advice
- Technical or engineering advice
8.3 FULL DISCLAIMER OF LIABILITY FOR AI OUTPUTS
To the fullest extent permitted by applicable law, Izaz Iqbal Ltd disclaims all liability for any loss, damage, harm, or consequence arising from or in connection with:
- Reliance on any AI Output generated by the Niftact platform
- Inaccurate, incomplete, or misleading AI responses
- AI responses that do not reflect the Customer's intended content
- AI "hallucinations" or fabricated information
8.4 CUSTOMER RESPONSIBILITY FOR AI QUALITY
Customers who use the Knowledge Base feature to train the AI on their own content are responsible for ensuring that the documents they upload are accurate, current, and lawful. Niftact is not responsible for AI Outputs that are inaccurate due to incorrect or outdated content uploaded by the Customer.
8.5 HUMAN OVERSIGHT RECOMMENDED
We strongly recommend that Customers configure escalation to a human agent for sensitive queries and that End Users are made aware they are interacting with an AI system.
9. INTELLECTUAL PROPERTY RIGHTS
9.1 NIFTACT'S INTELLECTUAL PROPERTY
All intellectual property rights in and to the Niftact platform, including but not limited to:
- The website (www.niftact.com) and app (app.niftact.com)
- The Widget code and script
- The platform's source code, algorithms, and architecture
- Niftact's proprietary AI model
- All designs, graphics, user interfaces, and branding
- The "Niftact" name, logo, and trademarks
...are owned exclusively by Izaz Iqbal Ltd and are protected by applicable intellectual property laws worldwide.
9.2 LIMITED LICENCE TO USE
Subject to your compliance with these Terms, Izaz Iqbal Ltd grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Niftact Service solely for your internal business purposes in accordance with your subscription plan.
9.3 RESTRICTIONS
You must not:
- Copy, reproduce, or redistribute any part of the Niftact platform
- Create derivative works based on the Niftact platform
- Use Niftact's name, logo, or branding except as expressly permitted in Section 12
- Remove or alter any proprietary notices or labels on the platform
9.4 THIRD-PARTY IP
The Niftact platform incorporates third-party technology including AI models from OpenAI and Google, and voice technology from Vapi. These remain the intellectual property of their respective owners and are subject to their own terms and licences.
10. USER CONTENT & DATA OWNERSHIP
10.1 YOU OWN YOUR CONTENT
You retain full ownership of all Content you upload, create, or configure within the Niftact platform. This includes:
- Documents uploaded to your Knowledge Base
- Chat history and conversation logs
- Widget configurations and settings
- Lead data collected through your Widget
- Help Desk FAQs and starter questions you create
10.2 LICENCE GRANTED TO NIFTACT
By uploading or creating Content within Niftact, you grant Izaz Iqbal Ltd a limited, non-exclusive, royalty-free licence to store, process, and use your Content solely for the purpose of:
- Delivering the Niftact Service to you
- Powering your AI chatbot with your Knowledge Base content
- Generating escalation notifications and analytics for your account
This licence does not permit us to share your Content with other Customers or to use it for any purpose outside of providing the Service to you.
10.3 NO TRAINING ON YOUR DATA
Niftact does NOT use your Content or your End Users' conversation data to train any AI model, including our own proprietary model.
10.4 CONTENT RESPONSIBILITY
You are solely responsible for ensuring that any Content you upload does not infringe the intellectual property rights of any third party and complies with all applicable laws. Niftact is not responsible for Content uploaded by Customers.
10.5 DATA UPON TERMINATION
Upon account deletion or termination, your Content and data will be deleted in accordance with the retention schedules set out in our Privacy Policy.
11. FEEDBACK & FEATURE SUGGESTIONS
11.1 WELCOME FEEDBACK
We welcome feedback, suggestions, and feature requests from our Customers. If you submit ideas, suggestions, or feedback about Niftact (collectively "Feedback"), you:
- Retain ownership of any original ideas you submit
- Grant Niftact a perpetual, worldwide, royalty-free, irrevocable licence to use, implement, modify, and incorporate your Feedback into the Niftact platform without any obligation to compensate you or credit you
11.2 NO OBLIGATION
Submission of Feedback does not obligate Izaz Iqbal Ltd to implement, consider, or respond to any suggestion. We have no duty to keep any Feedback confidential unless separately agreed in writing.
11.3 HOW TO SUBMIT FEEDBACK
You may submit Feedback by emailing support@niftact.com or through any feedback mechanism made available within the platform.
12. WHITE-LABEL & BRANDING
12.1 FREE PLAN — NIFTACT BRANDING DISPLAYED
Customers on the Free plan will have Niftact branding displayed on the chat Widget embedded on their website. This branding is not removable on the Free plan and must not be obscured, hidden, or modified in any way.
12.2 PRO & BUSINESS PLANS — WHITE-LABEL AVAILABLE
Customers on Pro and Business plans may remove Niftact branding from their Widget and customise it to match their own brand identity. This white-label capability is only available on these paid plans.
12.3 NIFTACT NAME & LOGO
You may not use the Niftact name, logo, trademarks, or other brand assets in any way that:
- Implies endorsement or partnership with Niftact without our prior written consent
- Misrepresents your relationship with Niftact
- Violates any applicable trademark or intellectual property law
Any permitted use of Niftact branding must comply with any brand guidelines we publish from time to time.
13. SUBSCRIPTION PLANS & BILLING
13.1 PLANS & PRICING
Niftact is available on three plans. Current pricing is:
- Free Plan: $0 / forever (no credit card required)
- Pro Plan: $59.99 / month
- Business Plan: $74.99 / month
All prices are in US Dollars (USD) and exclude any applicable taxes, unless otherwise stated.
13.2 BILLING CYCLES
Paid plans are available on monthly bases.
13.3 AUTO-RENEWAL
All paid subscriptions automatically renew at the end of each billing period (monthly). You authorise Niftact and Stripe to charge your payment method on the renewal date. You will receive advance email notice before each renewal. To prevent renewal, you must cancel your subscription before the renewal date (see Section 15).
13.4 PAYMENT PROCESSOR
All payments are processed securely by Stripe, Inc. By subscribing to a paid plan, you agree to Stripe's terms of service and privacy policy. Niftact does not store your card details — these are handled entirely by Stripe.
13.5 TAXES
You are responsible for all applicable taxes, duties, or levies imposed by your jurisdiction in connection with your use of Niftact. Prices displayed may not include VAT or other local taxes where applicable.
13.6 PRICE CHANGES
We reserve the right to change our pricing at any time. We will notify existing paying Customers of any price changes by email with reasonable advance notice before the change takes effect. Your continued use of a paid plan after the effective date of the price change constitutes your acceptance of the new pricing. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
14. REFUND POLICY
14.1 NO REFUNDS
All payments made to Niftact are non-refundable. This applies to:
- Monthly subscription payments
- Any partial billing periods
14.2 NO PRO-RATA REFUNDS
We do not offer pro-rata or partial refunds for unused time remaining on any subscription period, whether monthly.
14.3 EXCEPTIONAL CIRCUMSTANCES
In exceptional circumstances (for example, a significant technical failure on our part that rendered the Service unusable for an extended period), we may, at our sole discretion, consider offering a credit or partial refund. Such consideration does not constitute a right to a refund and is entirely at our discretion.
14.4 UK CONSUMER RIGHTS
If you are using Niftact as an individual consumer (not as a business), UK consumer law may provide you with additional rights, including a statutory 14-day cooling-off period for digital services purchased online. By using Niftact and requesting immediate access to the Service upon sign-up, you acknowledge that the cooling-off period may no longer apply once the Service has begun. If you have questions about your consumer rights, please contact support@niftact.com.
14.5 FREE PLAN
As the Free plan is provided at no charge, no refunds are applicable.
15. CANCELLATION & PLAN CHANGES
15.1 HOW TO CANCEL
You may cancel your paid subscription at any time from your Niftact account settings dashboard. Cancellations take effect at the end of the current billing period.
15.2 ACCESS AFTER CANCELLATION
Upon cancellation of a paid plan, you will retain full access to your plan's features until the end of your current billing period. After the billing period ends, your account will be automatically downgraded to the Free plan.
15.3 DOWNGRADE TO FREE PLAN
When downgraded to the Free plan:
- Chat history beyond the Free plan's 30-day retention limit will be automatically deleted in accordance with our data retention policy
- Team member seats exceeding the Free plan limit (1 seat) will be removed; we will notify you in advance to allow you to designate which team members to retain
- Knowledge Base documents will be retained but AI training may be deactivated until you upgrade again
- White-label settings will be removed and Niftact branding will reappear on your Widget
15.4 UPGRADING PLANS
You may upgrade your plan at any time. Upgrades take effect immediately. You will be charged a pro-rata amount for the remainder of your current billing period at the new plan rate.
15.5 DOWNGRADING PLANS
Downgrades from a higher to a lower paid plan take effect at the end of your current billing period.
15.6 ACCOUNT DELETION
To permanently delete your account and all associated data, you may use the account deletion feature within the Niftact app. Account deletion is permanent and irreversible. All data will be deleted in accordance with our Privacy Policy.
16. FAILED PAYMENTS & DOWNGRADES
16.1 FAILED PAYMENT
If a payment for your subscription fails for any reason (e.g., expired card, insufficient funds, bank decline), your account will be immediately downgraded to the Free plan.
16.2 IMMEDIATE DOWNGRADE
Unlike a voluntary cancellation (where access continues to end of billing period), a failed payment results in an immediate automatic downgrade. You will lose access to paid plan features immediately upon payment failure.
16.3 DATA IMPLICATIONS OF DOWNGRADE
Immediate downgrade due to failed payment carries the same data implications as a voluntary downgrade (see Section 15.3), including potential deletion of chat history beyond the 30-day Free plan limit.
16.4 REACTIVATION
To reactivate your paid plan after a failed payment, simply update your payment method in your account settings and resubscribe. If data was lost during the downgrade period, it cannot be recovered.
16.5 NOTIFICATION
We will send an email notification to your registered email address in the event of a failed payment. It is your responsibility to keep your payment details up to date in the Niftact dashboard.
17. SERVICE AVAILABILITY & MAINTENANCE
17.1 BEST-EFFORT AVAILABILITY
Izaz Iqbal Ltd endeavour to keep the Niftact platform available and operational at all times. However, we do not currently provide a formal Service Level Agreement (SLA) or uptime guarantee. The Service is provided on a best-effort basis.
17.2 NO GUARANTEED UPTIME
We do not warrant or guarantee that:
- The Service will be uninterrupted, error-free, or always available
- The Service will be free from bugs, viruses, or technical faults
- Any specific feature will remain available at all times
17.3 MAINTENANCE
We may perform maintenance on the Niftact platform at any time, which may result in temporary downtime or reduced functionality. We do not guarantee advance notice of maintenance windows, though we will attempt to minimise disruption where possible.
17.4 THIRD-PARTY DEPENDENCIES
Niftact relies on third-party services including Vercel (hosting), OpenAI, Google, Stripe, and Vapi. Any disruption to these third-party services may affect the availability or performance of Niftact. We are not liable for downtime or degraded performance caused by third-party providers.
17.5 FORCE MAJEURE
We are not liable for any failure to provide the Service due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, or failures of third-party infrastructure.
18. SUSPENSION & TERMINATION
18.1 WARNING FIRST
In most cases of a Terms violation, we will issue a written warning to your registered email address before taking further action. The warning will describe the nature of the violation and what is required to remedy it.
18.2 SUSPENSION
If a violation continues after a warning, or if the violation is repeated, we may suspend your account. During suspension:
- You will not be able to access the Niftact platform or your Widget
- Your Widget will cease to function on your website
- Your data will be retained in accordance with our Privacy Policy
18.3 TERMINATION
We may permanently terminate your account without prior warning in cases of:
- Serious or repeated violations of these Terms
- Illegal activity conducted through the platform
- Actions that pose a risk to the security or integrity of Niftact or harm to other users or third parties
- Non-payment (see Section 16)
18.4 EFFECT OF TERMINATION
Upon termination of your account:
- Your access to all Niftact features will be immediately revoked
- Your Widget will cease to function on all websites
- Your data will be deleted in accordance with our Privacy Policy
- Any outstanding amounts owed will remain payable
- Sections of these Terms that by their nature should survive termination will do so (including Sections 9, 10, 14, 19, 20, 24)
18.5 TERMINATION BY YOU
You may terminate your account at any time by deleting your account via the Niftact app. Termination does not entitle you to a refund (see Section 14).
18.6 TERMINATION BY US
We reserve the right to discontinue the Niftact Service entirely with reasonable notice to Customers. In such a case, we will provide Customers with an opportunity to export their data.
19. LIMITATION OF LIABILITY
19.1 DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Niftact Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
19.2 EXCLUSION OF LIABILITY
To the fullest extent permitted by law, Izaz Iqbal Ltd shall not be liable for any:
- Loss of profits, revenue, or business
- Loss of data or information
- Loss of goodwill or reputation
- Indirect, incidental, special, consequential, or punitive damages
- Damages arising from AI Output inaccuracies or hallucinations
- Damages arising from third-party service outages (Vercel, OpenAI, Google, Stripe, Vapi, or HubSpot)
- Damages arising from unauthorised access to your account
...whether or not we have been advised of the possibility of such damages and regardless of the theory of liability.
19.3 CAP ON LIABILITY
Where liability cannot be fully excluded by law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the total amount you paid to Niftact in the 3 months immediately preceding the event giving rise to the claim. For Free plan users, our liability is capped at £100 GBP.
19.4 CONSUMER RIGHTS NOT AFFECTED
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited by English law, including rights under the Consumer Rights Act 2015
19.5 BUSINESS USERS
If you are using Niftact as a business, you agree that the exclusions and limitations of liability in this Section 19 are reasonable given the commercial nature of the agreement and the pricing of the Service.
20. INDEMNIFICATION
20.1 YOUR INDEMNITY
You agree to indemnify, defend, and hold harmless Izaz Iqbal Ltd, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- (a) Your violation of these Terms
- (b) Your use of the Niftact Service in breach of applicable law
- (c) Content you upload that infringes third-party rights
- (d) Your deployment of the Widget and its use by your End Users
- (e) Your failure to obtain required consents from End Users
- (f) Any claim by an End User arising from your use of Niftact
20.2 COOPERATION
We will notify you promptly of any claim subject to indemnification and cooperate reasonably in its defence. You shall not settle any claim without our prior written consent where it imposes obligations or restrictions on Niftact.
21. THIRD-PARTY SERVICES & INTEGRATIONS
21.1 THIRD-PARTY PROVIDERS
Niftact integrates with and relies upon third-party services to deliver its functionality, including:

- Google LLC (AI model & sign-in) — policies.google.com/terms
- Vapi (voice AI platform) — vapi.ai/terms
- Stripe (payment processing) — stripe.com/legal
- Vercel (hosting) — vercel.com/legal/terms
- HubSpot (CRM, Business plan) — legal.hubspot.com/terms-of-service
21.2 NO RESPONSIBILITY FOR THIRD PARTIES
Izaz Iqbal Ltd is not responsible for the availability, accuracy, content, or practices of any third-party service. Your use of these services is subject to their own terms and conditions. We encourage you to review the terms of each provider before use.
21.3 THIRD-PARTY CHANGES
Third-party providers may change their terms, pricing, or availability at any time. Such changes may affect the functionality of Niftact. We will not be liable for any impact caused by changes to third-party services, though we will endeavour to notify Customers of material changes where possible.
21.4 LINKS FROM NIFTACT
Our website may contain links to external websites. These links are provided for your convenience only. We have no control over and accept no responsibility for the content of external websites.
22. PRIVACY & DATA PROTECTION
22.1 PRIVACY POLICY
Your use of Niftact is also governed by our Privacy Policy, available at www.niftact.com/privacy. The Privacy Policy is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.
22.2 DATA PROCESSING
Where you use Niftact to collect or process personal data of your End Users, you act as the Data Controller and Niftact acts as your Data Processor. This relationship is governed by our Privacy Policy and, for Business plan Customers, may be supplemented by a separate Data Processing Agreement (DPA).
22.3 GDPR & UK GDPR COMPLIANCE
Izaz Iqbal Ltd complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Customers are responsible for their own compliance with applicable data protection laws in their jurisdictions.
22.4 CUSTOMER DATA PROTECTION OBLIGATIONS
By using Niftact to collect End User data, you warrant that:
- You have a lawful basis for collecting and processing End User data
- You have provided appropriate privacy notices to your End Users
- You will comply with all applicable data protection laws
- You will not instruct Niftact to process data in a manner that violates applicable law
23. CHANGES TO THE SERVICE & THESE TERMS
23.1 CHANGES TO THE SERVICE
We reserve the right to modify, update, enhance, or discontinue any part of the Niftact Service at any time. For minor changes (such as UI improvements, bug fixes, or small feature additions), we may make changes without prior notice. For material changes that significantly affect paid plan functionality, we will provide reasonable advance notice by email.
23.2 CHANGES TO THESE TERMS
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Effective Date" at the top of this document
- Publish the updated Terms at www.niftact.com/terms
- Notify registered Customers by email
For minor or non-material changes (e.g., corrections or clarifications), we will update the Terms without direct email notice.
23.3 CONTINUED USE
Your continued use of Niftact following notification of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using Niftact and may delete your account at any time.
23.4 PREVIOUS VERSIONS
Previous versions of these Terms are available on request by emailing support@niftact.com.
24. GOVERNING LAW & DISPUTES
24.1 GOVERNING LAW
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales, regardless of the jurisdiction from which you access the Service.
24.2 GLOBAL USERS
Niftact is available to users worldwide. While English law governs these Terms, we acknowledge that users in certain jurisdictions may have mandatory statutory rights that cannot be overridden by contract. Nothing in these Terms is intended to limit any rights you may have under the mandatory laws of your own jurisdiction.
24.3 DISPUTE RESOLUTION
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, we encourage you to first contact us at support@niftact.com to attempt to resolve the matter informally. We will make reasonable efforts to resolve any dispute promptly and fairly.
24.4 JURISDICTION
If a dispute cannot be resolved informally, both parties agree to submit to the non-exclusive jurisdiction of the courts of England and Wales. "Non-exclusive" means that if you are a consumer in another jurisdiction, you may also have the right to bring a claim in the courts of your own country.

25.2 OUR RESPONSE

25.3 ESCALATION
If you are not satisfied with our response, you may escalate your complaint through the courts of England and Wales (see Section 24) or, for data protection complaints, to the Information Commissioner's Office (ICO) at https://ico.org.uk/make-a-complaint.
26. MISCELLANEOUS
26.1 ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated herein, constitute the entire agreement between you and Izaz Iqbal Ltd regarding your use of Niftact and supersede all prior agreements, understandings, and representations.
26.2 NON-TRANSFER BY NIFTACT
Izaz Iqbal Ltd will not transfer or assign its rights and obligations under these Terms to any third party without your consent, except in the event of a corporate restructuring, merger, or acquisition, in which case we will provide reasonable notice. If you do not agree to the transfer, you may terminate your account.
26.3 NON-TRANSFER BY YOU
You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.
26.4 SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be deemed modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.
26.5 WAIVER
Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Izaz Iqbal Ltd.
26.6 NO PARTNERSHIP OR AGENCY
Nothing in these Terms creates any partnership, joint venture, employment, franchise, or agency relationship between you and Izaz Iqbal Ltd.
26.7 HEADINGS
Section headings in these Terms are for convenience only and do not affect the interpretation of these Terms.
26.8 LANGUAGE
These Terms are written in English. In the event of any conflict between an English version and a translated version of these Terms, the English version shall prevail.
